COURT OF APPEAL A WANGANUI CASE Legal argument in connection wit'li a claim for specific performance of an agreement- was heard in the Court of Appeal yesterday before Their Honours Mr Justice Edwards, Jlr. Justice Cooper and Mr. Justieo Chapman. Tho plaintiffs in tho case were G. C. B. Harper, farmer, of Makirikiri, near Wangaiuii, and W. W. Taylor, farm manager, of Pukcroa. The defendants were A. J. Joblin, farmer, of Tailiapc, and his wifo (Mrs. Joblin). Counsel for the plaintiffs were' Sir Francis Bell, K.C., Mr. C. I'. Skerrett, K.C., and Mr. A. D. Brodie, while the defendants were represented by Sir John Findlay, K.C., and Mr. J. M. Hussey. Plaintiffs alleged that, in consideration of the plaintiff Harper guaranteeing A. J. Joblin's account with tho Union Bank for a fixed sum, Mrs. Joblin should offer certain lands as security, tho palintiff having an option to purchase oii certain conditions. Plaintiff Harper, who had assigned his interest to tho plaintiff Taylor, now sought specific performance of an agreement that had been entered into, and the terms of the agreement consequently came into question. Evidcnco in tho action was heard at Wanganui, and by direction of the presiding Judge (Mr. ,Justice Edwards) the case was removed into the Court of Appeal for argument. Hearing was not concluded last evening, and tho caso lias been adjourned until 10.30 a.m. to-day.
