The monthly sitting of the Petone Magistrate's Court, held yesterday, was presided over by Mr. D. G. A. Thomas Kearns was charged with assaulting his wife, Mary Jane Kearns. Kearns denied the charge, but the evidence was against him, and a fine of £2, with 7s. costs, wa imposed. Default was fixed at fourteen days' imprisonment. Ajs a result of a quarrel, Thomas M'lntosh and Emanuel Floyd appeared to answer a charge of using threatening behaviour, whereby, a breach of tho peace wa3 occasioned. Each accused was penalised in the sum of 10s., and 9s. costs/in default ordered to serve 48 hours in gaol. James Martin, who was'charged with, failing to send llis child to school, was fined'los., with 7s. costs, in default 48 hours' imprisonment. . ~ Hannah Symes applied for a separation and maintenance order against'her husband, Charles ' Symes, on the grounds of persistent cruelty and failure to maintain. According to the wife's evidence, £ha palrties got on well together. until' aboifti three years ago. About that time Symes met with an accident to his head, ever since 'which he had had periodical fits of temper, which made things unbearable in the home. Just lately Symes had left home, and the had not Teceived any money. In his evidence, Symes characterised his wife's statements as falsehoods, alleging that he had never 6truck her in his life. The application was granted, custody of the children being jjiven complainant. Defendant was ordered to pay 2os. per week towards the support of the family.
