A' civil dispute arising out of a t recent caso in which two circus employees sued a oircus' manager for boat fares to Sydney, was heard by Mr. D. G. A. Cooper, S.M., yesterday afternoon. Tlio parties in the original case were Frederick and Olive Leonard, plaintiffs, and Frank J. Barton, defendant, and the Magistrate then gave judgment for! plaintiffs for the fares, on condition that they left for Sydney by a certain v date. Plaintiffs, did not leave for Sydney, and the judgment was accordingly voided. In the new dispute, the position of the parties was reversed, Frank J Barton claiming from the two Leonards £6 10s. Plaintiff alleged that he had incurred considerable expense _in defending the previous action, which was not a bona fide one, in that the Leonards did not want the 'fares, but merely sued plaintiff to "show him up." After hearing the evidence, His Worship said t'lmt it clearly showed that. ■ the Leonards had intended to stop ; in' New Zealand. Judgment would be given for plaintiff for £6 10s., with costs £3 3s. Plaintiff further claimed from tho defendant, Fred Leonard, £3 3s. for services •of a stallion, alleged to bo rendered in September, 1914, and 10s. driving fees. The Magistrate disallowed this amount, howover. Mi-. H. F. O'Leary appeared for plaintiff, and Mr. Douglas Jackson for defendants.. 1
