The case in which one August Neilsen is claiming £150 damages against the .Wharf Labourers' Union on the grounds of preventing him from obtaining employment as a wharf labourer, allegedly because he was German-bom, resulted in a nonsuit. , Li the course of examination counsel for the defence, in seeking to show that the funds necessary to bring the 1 action had been subscribed by Germans, asked the plaintiff if he were a thorough Australian. Receiving an affirmative reply, oounsel added: "Then, say, 'Down with the Kaiser!'" The Judge told Neilsen not to say the words., because tliat would be improper.
