DRASTIC REGULATIONS y r 8 TO DEAL WITH SUSPICIOUS GOODS a. e 8 s Regulations under the War Regula- } tions Act, which are intended to circumvent efforts to trade in goods of enemy origin, or of otherwise suspicious cliar- ~ acter were published in a Gazette Ex- ! traordiuary last night. Following are the operative clauses: — "2. Whon any goods are imported into New Zealand directly or indirectly 8 from any country other than the TJnit- ? Ed Kingdom or a British possession, and a Collector of Customs has reason 7 to believe that the goods are of a kind description, or quality not customarily » exported from that country to Now 0 Zealand prior to the commencement of 0 the present war, or if he has reasonable ; grounds for suspecting that the goods _ are of enemy manufacture, origin, or ownership, or that the importation thereof is contrary to the law as to 1 trading with the enemy, he may. detain , those goods, and they shall not be delivered from the control of the Customs j until the Collector is satisfied that the goods are not of enemy manufacture, I origin, or ownership, and that they i have not been imported in violation of j the laws as to trading with the enemy. "3. On any goods being so detained . as aforesaid, notice of the detention , thereof shall be given by or on behalf • of the Collector of Customs to the im- £ porter, or to his agent_ or representac tive. and after the receipt of such notice it shall not bo lawful, so long as T the detention continues, for the im- ' porter or any other persons to pay or = remit to any person any sum of money in respect of the purchase or consign-, ment of those goods, or to accept.' make, pay, negotiate, or otherwise deal with any bill of exchange or other nego--9 tiable instrument for the price of those r goods or otherwise having relation >. thereto. , 7 "4. (1.) When any goods have been rr so detained, and notice has been so | given as aforesaid, the Comptroller of y Customs may, if he thinks fat, deliver r the same from the control of the Cusj toms on receiving from the importer, or 3 his agent or representative, a deposit 3 of a sum equal to the fair market value of those goods as estimated by the Comptroller in accordance; as far as may be,, with the provisions of the Customs Act, 1913, as to ad valorem duty, a "(2.) The sum so deposited shall be 3, returned as soon as the Comptroller is - satisfied that the goods are not of enemy manufacture, origin, or owner--1 ship, and that they have not been ims ported in violation of the laws as to i trading with the enemy, or so soon as s the present war has come to an end, ■ whichever first happens. l "(8.) So long as any such deposits is 1 retained Clause 3 of these regulations & shall apply in the same manner as if , the goods were still detained. "5. If any goods are detained in pursuance'of these regulations, they snail not thereafter be delivered from the coateol of the Customs until ■ the im--3 porter has refunded, or undertaken to 3 the satisfaction of a Collector of Cus- ' toms to refund, all oxpenses incurred by 5 the Crown in respect of tile detention ' and storage thoreof; and any such goods 1 may at any time while tlicy remain un- ) der the control of the Customs be sold 1 by the Comptroller of Customs for the J purpose of refunding to the Crown out J of the Droceeds of such sale all expenses so incurred by the Crown, whether with " respect to the goods so held or any • other goods imported by the same importer. "6. While any goods are so detained as aforesaid, it shall not bo lawful for ) any person to take possession of the ) same or to interfere in any other man- ) ner with the right of detention and > oontrol hereby conferred upon the Col- ■ lector of Customs. , "7. The decision of a Collector of r Customs as to the country from which • any goods have been imported into New F Zealand shall, for the purposes of these . regulations, be final and conclusive."
