SETTLED OUT OF COURT
. BREACH OF„,PROMISE CASE.. (By Telegraph.—Press Association.) " Dunedin, May 17. The breach of promiso caso Violet Campbell v. Rev. Ralph Bray, of Wellington, was set- down for trial before Mr. Justice-Sini 'to-day. Plaintiff alleged" that' during ' the year 1907, at jDunedin, the parties verbally promised to marry one another; that on May 6 of last year Bray married another lady; wherefore plaintiff claimed £500. Plaintiff further said that, relying on Bray's promise she 6ent him presents valued at £141 19s. 6d., freight and postage costing £50 more. Bray returned many of the presents, but the goods wheu returned had depreciated, and plaintiff had to pay freight and cartage, wherefore she claimed a further sum of £135 lis. lid. ,
Defendant in his statement denied t'he promise to marry. He denied also that present 6 were given in ' reliance upon any 6Uoh promise. At tile appointed hour to-day the parties asked for time to discuss the question of a settlement. An hour later Mr. W. 0. Maogregor, counsel for plaintiff, announced that the parties had agreed to a settlement upon these terms:—Plaintiff withdraws the claim for breach of promise;. she also withdraws the assertion that there was a promise; the action to be discontinued. Defendant, having returned as far as possible the presents given by plaintiff, will pay her forthwith £50 to cover depreciation and in full settlement of all claims relating to 'suoh presents. Mr. Hanlon, counsel for defendant, agreed, and His Honour said there was no need to enter up any judgment.
