MORTGAGES EXTENSION ACT
'An application for leave to exercise power for sale in a mortgage under the Mortgages Extension Act was made at 1 the Supreme Court yesterday morning before his Honour Sir. Justice Hoskine. The plaintiffs were the Wellington Trust and Investment Company, and the defendants Alexander Murray Williams, Mrs. Jane Coe, and Leonard Joseph Z ill wood. Tho owner of the land made clefault in payment of interest. A prior owner was Williams, and Zillwood was second mortgagee. Zillwood was prepared to pay the interest in arrear to save'his security. ' • His Honour made an order that bo long as the interest was paid by the mortgagor the sale of the land could not proceed. Mr. H. E.. Evans appeared for the Wellington Trust and Investment Company, Mr. C. H. Treadwell for Williams, and Mr. T. Neave for Zillwood. QUESTION OF COSTS. In the ' Supreme Court yiesterday morning, His Honour Mr. Justice Hosking gave his judgment on the question of costs in connection with the summons by the liquidator of the British Empire Petroleum Company to enforce payment of application moneys due by oertain shareholders, namely: Mrs. Hadley, of Auckland; John Hardley, of' Auckland; J.' W. Hardley, of Auckland; and Te Heu Heu Tukino, of Wellington. The summons had been dismissed in a judgment delivered on" Friday, and yesterday His Honour ordered the liquidator to pay 10 guineas each to Mrs. Hadley and Te Heu Heu Tukino, together with disbursements^
