LOWER HUTT COURT
Mr. D. 6. A. Cooler, S.M., presided at tho' monthly sitting of the Lower Hutt Magistrate's Court yesterday. MesfcTs. Oudby, Wilkin, and Peterkin were also on the Bench. Edward Bennett' pleaded guilty to a charge'of drunkenness, and also using obscene language at the Lower Hutt Railway Station. On the charge of drunkenness defendant was convicted and discharged, while for obscene language he was lined'£3, in default one month's imprisonment. Seven days were allowed in which to pay the fine. For allowing stock to wander at large Thomas Reesby was fined 10s. with costs 75., on each of two charges, in default three days' imprisonment. Thomas Swenseon, was charged with striking John Lynch. According to the evidence of plaintiff some trouble had taken ■ place concerning a horse, which was alleged to have been placed in plaintiff's father's paddocks. On January 18 plaintiff and his brother were proceeding along the road, when defendant, dismounting from a cart ho was driving, and struck Lynch. Plaintiff was stunned by the blow. He had to receive medical attention. Plaintjlf denied hitting Swensson. After evidence had been heaid, His Worship decided to penalise Swensson in the sum of £1, with costs (£1 Is.). Default waß fixed at three days in gaol. Edith Osborno claimed'£lso damages from Nicholas Berg, of Lower Hutt, alleging that on or about November 13 last defendant falsely and maliciously spoke and published of the plaintiff, to Ida Osborne, the following words :— "There'are things missing out of'my room. There is £3 missing out of my drawer, which I want you (referring to and meaning plaintiff) to account for." Plaintiff further alleged that on or about tho same time the defendant falselely and maliciously spoke and published of plaintiff to Constable Cameron, Gail Skinner, and Ida Osbome, tho following words:—"lf it costs me £5 or £10 1 will not give up the things (meaiiing Osborne's belongings) iintil 1 get a wan-ant to have her (meaning plaintiff) boxes searched. If the girl (meaning plaintiff) gives me the £3 she can have her boxes," defendant meaning by the words that plaintiff had stolen the sum of £3 and other property from the defendant, and was guilty of a criminal offence. Plaintiv also claimed £7 from defendant for. wrongful detention of certain personal belongings alleged to have been wrongfully detained by defendant, for whom plaintiff acted as housekeeper. Evidence was given by Edith Osborne, Constable Cameron, Edith Marion Foothead, and Wm. Hanley, when'the caee waa adjourned until 2.15 p.m. to-day, at the Magistrate's Court, Wellington.
CIVIL CASES. W. Whitehead as assignee for G. A. M'llvride, claimed £5 19s. 6d. from W. M. Coniick, being the balance of purchase money for building a coach. Dofendant claimed that the springs were unsatisfactory, two having 'been replaced whilst a third was in need of repair. Judgment was given for claimant for £5 75., with 265. costs and 14s. witness's expenses. Judgment was given for plaintiff in respect to tho Jiutt River Board v. Mamma Eomini, £1 18s. 6d., and 15s. costs. J. ' Niinhivillo was ordered to pay G. M. M'llvrido £3 Is., in mnothl.v payments of 10b., the first instalment to jaa made at the.,cad of li'ebruary.,.
