A CONVICTION QUASHED
(By Tdezrfcph.—Press Association.) Dunodln, December 22. In the Supreme Court to-day Messrs. Stout and O'Beirno, of InvereargiJl, appeared iu support of a motion to quash the conviction of John Kerrigan, of Campbelltown (Bluff), hotelkeeper, on a charge of selling liquor to a- person already in a state of intoxication. Mr. Macalister, of Invercargill, appeared to i oppose tlio motion. After hearing argument, Mr. Justice Sim held 'that the conviction, bo far as it embodied the endorsement of the license, was bad, and must be struck out. The> irregularity was the pronouncing of the sentence that defendant should be fined and his license endorsed before any attempt was made to comply with Section 247 of th'o Licensing Act. The Magistrate did not inspect the register be- I fore giving his decision. No costs were allowctl. An application by C. J. A. n. dipping and another, owners of the hotel, for possession of the premises., arrears of rent, etc., was adjourned to Invercargill for evidence.
