THE ZAMBESI CASE
JUDGMENT RESERVED (Rec. December 17, 10.15 p.m.) ' Sydney, December 17. Judgment has been reserved in the, Zambesi case. "" Tho Prize Court heard an application from the Commonwealth Government to have the ship Zambesi and her cargo—captured by the warship Encounter off Rabaul—declared to bo a lawful prize. Tho petitioner's claim sets out that the Zambesi was a Britishowned vessel charter to the Pacific Phosplfate Company; that on August 6 the master of the ship received through the agents for tho company, and on behalf of the Kaiser, orders to proceed from Naura Island to Rabaul with the agent of the Kaiser (who was carrying important telegrams in relation to "the war), and on arrival at Rabaul to hold himself and his ship at the disposal of the German Government. Respondent's case declared that at the time of the departure from Naura, the agent of the charterers of the Zambesi and her captain wero not aware that war existed between Britain and Germany.
