COURT OF APPEAL DECISION. (Rec. December 9, 0.20 a.m.) London, December 8. The Court of Appeal, differing from Mr. Justice Sargent's judgment in the Zino Corporation case, decided that an aotion did not lio, because Hirsch and Sohn were not represented.' • Tho Zino Corporation 60Ught a decision as to whether its contract to sell tho whole of its outpcft to the German firm of Aaron Hirsch and Sohn until 1919 was voided by the war or merely suspended. Mr.. Justice Sargent held that the case was covered by the olause suspending the contract during the continuance of events beyond tne ; control of the vendors or' buyers and which prevented or delayed the carrying out of tho agreement. He granted an injunction restraining the directors from acting on the assumption that the contract had terminated, and added that it was undoubtedly a case.that should go to tho highest tribunal. ■ J
