John James Mullany at Napier on November 6, by means of false pretences. On his behalf Mr. E. J. nv r a plea of guilty. h,i?t scc',5 cc ' , ' Te Broberg explained tnat Hawthorne had represented himifi' k® a me mber of the firm of Hawthorne and Christie," timber merchants, of Wellington, and in this capacity bad got an order for £9 worth or timber from Mullany at Napier, 'l'he latter had' paid him £4 10s. by deposit. This money accused had appropriated for his own me. Accused, it was alleged, had been loafing and drinking about Napier for somo • time, leaving down in Wellington a wife and seven starving children. Fifteen years ago he had been convicted for theft and raise pretences. • Mr. Fitzgibbon pleaded for leniency. The £4 10s. would be refunded, while accused would agree to have a prohibition order taken out against him. If Hawthorne were imprisoned his family would lose their bread-winner, while defendant would lose the good position ho had just secured in the city. The Magistrate said ho would take the facts as stated by counsel.into consideration, and order accused to come up for sentence when called upon. The £4 10s. would have, to be' refunded within a fortnight. OTHER POLICE OASES. John Power, an old man and an old offender, both in respect to drunkenness and theft,? was cnarged with (1) being found drunk, (2) stealing six pairs of socks, valued at 65., from Richard Wilkins, (3) stealing a pair of canvas shoes, valued at 6s. 6d., from James Wm. Martin.. On the first charge ho was lined £1 or three days' imprisonment, arid on each of tho two other charges ho'' was sentenced to seven days' imprisonment. A young woman named Kitty O'Toole was sentenced to one month's imprisonment for importuning. Henry Greenfield, a prohibited person, was fined £2 or seven days' imprisonment for drunkenness, and £1 or three days' imprisonment for committing a breach of his ■ prohibition order. Two first offenders were dealt with for drunkenness.
' CIVIL CASES. 'A CHATTEL CLAIM. A dispute concerning an express, horse, and harness, valued at £35, formed the basis of a- civil claim heard before Mr. W, G. Riddell, g.M. R. M'lvor, widow, proceeded against.Walter Harold Mill, carrier, ior possession of the property under dispute, or £35, with £10 damages for detention. Plaintiff alleged that defendant had wrongfully detained the chattels in question. After hearing tho evidence, the Magistrate gave judgment for plaintiff, together with £2 damages and £4 costs. Mr. P. W. Jackson appeared for plaintiff, and Mr. J. F. W. Dickson for defendant..
