MAGISTRATE'S COURT

POLICE CASES. TWO YEARS AT ROTO ROA ISLAND. The polico gave a bad character to a married man named John Buckley, a prohibited person, charged with drunkenness. "Mo has a wife and six children dependent on him. He has done , no work for some time, goes about cadging in the street, returns home drunk, and uses filthy language to his wife," said Inspector Heudrey. "Ihopo your Worship will send him to Roto Roa Island for as long a period as th'o law permits." Accused's wife said that she had six children. Beyond tho assistance of friends, and the work sho did herself, she had no means of livelihood. Her husband was an habitual drunkard, and had done no work for a long timo. Frequently sho had instituted proceedings against him, but had withdrawn them

on receiving pledges that were only to bo broken by his drunkenness. Accused was committed to Roto Roa Island for two years. OTHER CASES. i Houg Leo, alias Jim Kee, pleaded not guilty to a charge of being found in the possession of opium. Mr. J. F. W.. Dickson appeared for the Chinaman, and asked for a remand, which was granted till October 23. Bail was allowed in tho sum of £50. John Smith, alias Walsh, alias Brown, was charged with drunkenness and indecency. On the first charge he was fined £1, or three days, and as this iras his third appearance in court for offences similar to tie latter he was fined £3, or fourteen days' gaol. Wni. Connell was fined: £2, or seven days, for indecency. Androw Munro appeared on remand charged wit'i helpless drunkenness. He was convicted and ordered to pay medical expenses, 17s. 6d., in default 24 hours' gaol. Robert >Warner was fined £2, or seven days, for using obscene language, and formally convicted for drunkenness. For drunkenness, Robert Rondall and Patrick Brady were each fined 10s., or , 48 hours' gaol. Four first offenders were dealt with. CIVIL BUSINESS. ATTACKED BY BULLDOG. Considerable evidence was taken in respect to a civil dispute beard before Mr. W. G. Riddell, S.M., in which Joseph Henry Bryant, labourer, of Newtown, proceeded against W. E. Liitz, butcher, of Willis Street, for the sum of £33 14s. The statement of claim laid out that on or about April 10 last plaintiff was attacked by defendant's bulldogs in Willie Street, and was bitten on his chest and logs. Hβ accordingly claimed £7 4s. 6d. (loss of wages through being incapacitated from work as the Tesult of tho injuries) £2 9s. 6d. (medical expenses), £4 (.damage to clothes), ana £20 (general damages). After hearing evidence the Magistrate- nonsuited plaintiff, as on tho day oJ the accident the latter had signed an, agreement in which he accepted 10s. hi cash and. an order for a new suit of clothes in settlement of tlie affair. Sir. E. J. Fitzgibbon appeared for plaintiff, and Mr. M. Myers for defendant.

CLAIM FOR GOODS. A claim for the recovery of goodu was heard heforo Mr. D. G. A. Cooper, S.M., when W. A. Brown, storekeeper, sued James Wallace Easson, timber merchant, for £29 9s. Plaintiff alleged that tho goods, which wore his property, had been taken by defendant about September 22 and detained until tho time of the entering of the plaint. Plaintiff had demanded the return of the goods, but was refused. A further claim of £10 as damages for the detention of tho goods was also mado. Mr. P. H. Putnam appeared for plaintiff, and Mr. T. Neavo for defendant. After a partial hearing tho case "was adjourned till next Thursday. BUTCHERS AT LAW. Two butchers were the parties to a civil dispute heard before Mr. W. G. lliddell, S.M., yesterday, when Thos. George Melianey, of 48 Nairn iStreot, butcher, proceeded against E. B. Jones, of Cuba Street, master butcher. Plaintiff alleged that on September 15 ho was assaulted by defendant, and claimed £5 damages in respect to tho assault, and £2 16s. —one week's wages due by defoudaut to plaintiff. Tho Magistrate remarked that both parties were evidently to bkine in respect to the assault, but lio considered that plaintiff was entitled to tho £2 16s. for wages. Judgment' was given accordingly,: with \'-sts. . Mr. K. J. Fitzgibbon appeared for plaintiff, and Mr. Kennedy for defendant, . ■ SUED BY HIS UNION. The Wellington Operative Bootmakers' Socioty Industrial Union of Work ers claimed the sum of £1 os. 6d. from Harry Monce, boot clicker : by ocjupation, being tho amount diie by defendant to the plaintiff union for subscriptions and fines to September 19. A counter-claim was made by defendant for tho sum of £12 10s. for' "benefits." After hearing considerable legal argument, tho Magistrate, Mr. W. G. Biddel!, gavo judgment for plaintiff in the claim and counter-claim. Mr. E. J. Fitzgibbon appoared for- plaintiff and Mr. P. W-. Jackson for defendant. JUDGMENT BY DEFAULT. George Wigert was ordered to pay John W. Bailey £1 7s. by October 29, in default 24 hours' gaol; John C.
