During the hearing of the case it appeared that each" party alleged that the. mishap was due to the other having taken the .wrong course. Mr. T. C. A. , Hislop: appeared for the,plaintiffs, and Mr. M. Myers for the' defendants. In the course of his judgment His Honour, ■ after referring to the conflicting nature of the evidence, cxDressed tho . opinion that some of the evidence given for the .plaintiffs .must be. negatived'., and plaintiffs were not entitled to 'succeed. In His Honour's opinion. -the mishap was attributable to the improper change of course on tho part of the Blenheim in the. channel. Judgment Lwould be for the defendant (Captain Eckford, owner of the- Opawa) with costs to be taxed on the Admiralty scale. ■...-•. Council informed tlio Court that costs could probably be agreed upon without reference to tho Registrar.
