: SUPREME COURT CRIMINAL SESSIONS ' TWO ACQUITTALS Before His Honour Mr. Justice Hosking the criminol sessions of tlio Supreme Court were continued yesterday morning. Mr. P. S. K. Macassey, of tho Crown Law Office, appeared for,the Crown. Alleged Theft. Philip George Kessler, a wharf labourer, and Yeative Kouo Mallalieu St. Mar, a seataring man, were oliarged with breaking and entering the dwollinghonss of William Sing, a Ghinese, and stealing therefrom certain goods valued at about £5. Mr. P. J. O'Regan appeared for both the accused, who pleaded not guilty. The evidence for the prosecution was to the effect that Sing had vacated No. 141 Taranaki Street on Ju&o 16, and on that date another Chineso (Ah Duck) entered into possession. Sing liad leftsome carpenters' tools in the houso, and. when the other Cliineso took possession, flio also brought with him eomo tools for tho purpose of carrying out certain', repairs. On June 18, Ah Duck loft the ■house securely locked, but on returning next morning' ho found that it liad been broken into, and the carpenters' tools. stolen. The accused were arrested' with portion of the stolen property in their, possession. ' ' ' Both accused gave evidence in their own defence. Their story was that they had found the stolen property on a vacant section at tho corner of 'Vivian Street, and Cambridge Terrace. After considering the case for over an hour the jury returned a verdict of "Not Guilty" and both the' accused wero' discharged. > Missing Letters. A married man, named Frederick David Plimmer, a letter-carriers' sorter by occupation, was indicted on two charges of theft of postal packets at ■Wellington. He pleaded not I guilty arid was defended by Mr. B. J. Pitzgibbon. , Particulars ot the evidence tendered in support of the prosecution weije published at length wlien the case was before the Lower Court in May last. One of the postal packets concerned contained postal notes to the value of 155., and the other contained, two <£1 notes and postal notes to the value of 12s. Gd. Two of the postal notes, were subsequently traced to "Tattersalls, Hobart; and accused in a statement to tho polico; admitted having posted one of them to that address, bnt declared that-he had purchased it from a woman near the entrance to the Posrt Ofhce. ' No evidence wa? called for the. defence, but/counsel for the accused addressed the jury. The jury retired at 5.40 p.m., and re- • turned two hours later with a verdict of guilty. The prisoner was remanded for sentence until to-morrow morning.
