CONSTABLE IN COURT

Dunedin, July'l7. : .Joshua Cecil .Painter, a police constable, was charged in the Police Court this' morning with a breach of a by-law by riding a bicycle at night without a ' light.' Evidence was given for the prosecution by a sergeant andconstable, ; who stated that defendant had no light. ■' The witnesses admitted that they had not stopped the defendant and examined his lamp. Defendant denied thechargej ' and stated that he had his lamp alight. This was supported by his wife and another constable. .The Magistrate dismissed the case, remarking that it was unfortunate that the sergeant and conBtable did not* stop the defendant, as he passed by. Possibly they had been mistaken. The only alternative:was to believe that defendant had committed. ■ perjury, and on the evidence he would be very reluctant' indeed to,'come to' that conclusion. • ■■■■ ■ . ■ . ■
