Evidence was given for the prosecution by a sergeant andconstable, ; who stated that defendant had no light. ■' The witnesses admitted that they had not stopped the defendant and examined his lamp. Defendant denied thechargej ' and stated that he had his lamp alight. This was supported by his wife and another constable. .The Magistrate dismissed the case, remarking that it was unfortunate that the sergeant and conBtable did not* stop the defendant, as he passed by. Possibly they had been mistaken.
