The* question as to whether tho new union oi. waterside workers at Auckland has power to go to an employer and insist on. the discharge of a, non-unionist employed on tho wharf was raised beforo Mr. C.-C. Kettle. S.M.,at the Magistrate's Court. Tho plaintiff in the action in question' was Frederick Mayman, one of the waterside workers who went on strike, who proceeded against the Auckland Watersido Workera' Industrial Union of Workers, alleging that the officials of tho new union intentionally and without lawful justification induced, the employer of .the. plaintiff to terminate a contract of service entered into on January 14, 1914, between plaintiff and tho employer. Hβ claimed £25 damages from tho union. Mr. Skelton, who appeared for plaintiff, in opening .the case, said that tho proceedings were somewhat of a test. The ox-strikers desired to know just exactly what was tho power of tho now union in regard.to tho matter of employment. .

Frederick Mayman, the plaintiff, Btatcd that he was engaged by an agent of the New Zealand Shipping Company to unload the coal-laden steamer Kilbrydo. ,He and his mates wero asked if they had_ their union tickets, and witness replied that ho had applied for admission to tho union. The agent then remarked that he.could not be bothered waiting any longer', and told them they had better start work.- They worked until lunch time, but, after lunclij they found that there- wore -two extra men in the hold. Tho agent of the New Zealand Shipping Company then said to witness and his mate that, in consequence of representations by tho union, he. would have to dispense with their cervices, but,-ho.-added that, if they joined the new union, they could go back to work. Afterwards tho secretary of tho new union told them that he had brought about ■ their dismissal on acof tho fact that they werp nonunionists.- ' •■ Cross-examined, _ witness explained that ho had applied for, admission to tho new union twice, but had been refused on each occasion. ■ The caso at this stage was adjourned.
