UPPER HUTT COURT.

The monthly sitting of the Upper Hutfc Magistrate's Court was held on Wednesday, and was presided over by Mr. J. S. Evans, S.M. The following were proceeded against for allowing stock to wonder: —Jacob Geange and I'ratt, each convicted and ordered to pay Court costs (75.); W. H. Edwards, fined 5s , costs 75.; and Mrs. Annie Souther (two charges), fined 2s. on the first chargo and convicted on the second. ( _ j In the civil action, Thomas Scrim- i shaw v. John Williamson, a claim for £■15 10s. and a counter-claim for £57 10s., lengthy evidence was taken. The parties to the action were brothers-in-law, and were for sonic time neighbouring farmers at Trentham. Mr. J. W. Card appeared for plaintiff, and Mr. Cr. H. Fell for defendant. The caso was brought about osvin;; ts> a dispute between tho parties as to the gracing of stock, plaintiff alleging that during his absence in America Williamson had used his property for grazing purposes, and had also used .his milking shod and various implements without permission. No arrangement had been come to by either side as to the grazing of the cattle. The defendant stated that Scrimshaw had arranged with him to look after his cattle' during his (Scrimshaw's) absence in America. The latter had agreed to pay him £2 per week iu wages, and had promised to give hint all tho heifer calves. Mrs. Scrimshaw had refused to hand ovef the calves, as she v/as unaware that any such agreement had been come to. He had not received the wages as promised by plaintiff. Mr. Fell contended that the _ entiro trouble had arisen through Scrimshaw not paying Williamson's wages. Tho latter liad agreed to take certain implements in lieu thereof, but some difficulty had arisen, and he liad not received the money. i

Alter hearing further evidence, the magistrate gavo judgment for plaintiff for the amount of &42 10s.. and for defendant (counter-claim) £41 Gs. Bd. Isoth parties were ordered to "pay their own cost's
