POSITION BATHER MIXED. (By TcleuraD)!.—J'ress Association.) Auckland, December 0. Tho hearing of a claim iit which tho circumstances were somewhat unusual was opened at tho Police Cmirt to-day, when Ellen Goorgina l'errin proceeded against William l'errin. Mr. Matthews, who appeared for complainant, slated that the parties wero married in 1891. Defendant, who had advertised without success for a woman whom he had previously married, had represented himself as a widower. Ho submitted that complainant was entitled to maintenance whether there had been another marriage or not. Mi'. 'Grundy, for defendant, applied for an adjournment, t?o that tho evidence of defendant might ho taken at I'almerstoii North. Ho added that,' if defendant could prove the existence of :\ marriage which had taken place before that with complainant, tho Court had no jurisdiction in respect to the latter.

Mr. Cnttcn, 8.M.: "Why do you suppose tbat the woman would go through a form of marriage with defendant if she know that ho was already married?" His Worship added that ho would have, to act on the marriage certificate before Mm unless another marriage could bo proved. Mr.'Grundy: That is why I wish to bring evidence.

Mr. Cut ten: You ran't expect much sympathy from the Court. "Mr. Grundy: I'admit that, hut the man probably thought that his first wife was dead at the time.

Au adjournment until January 13 was Granted.
