The police authorities recently prosecuted tho proprietor of a slot machine (which liad been, in use on board ona of the ferry steamers) on a. charge of Sunday trading. The Magistrate dismissed the charge, holding that tho machino was not an animate- tiring, and not the agent of the defendant, as no personal serv.ico had been rendered by 1 anyone. The police authorities then appealed to Mr. Justice Ferguson, who upheld the Magistrate. Mr. Justice Ferguson agreed that a transaction whereby cigarettes came into ihe possession or purchasers constituted, Sunday trading and trading by the proprietors' macliines, but no offence had been committed under tho Act, except when something was done, involving human labour and attention oft Sunday. , Ho added that it: had been urged that this ruling would open the door to evasions of the statute suppressing juvenile smoking. That, however, was a question which had no necessary relation to Sunday trading, and the solution depends on different considerations.
