COURT PROCEDURE ABUSED. SUMMONS TOO SUDDEN. Abuse of Court procedure was alleged yesterday by Mr. E. J. Fitzgibboii, who appeared as counsel for the defendant, in a case iu which Elizabeth
Jcrmyn sued Mrs. A. G. James for 65., an amount said to be due for sewing work. Mr. Fitzgibbon said that Mrs. James did not dispute the amount, but objected to judgment being entered against her, becauso she had not been asked for tho money. The first request had come in tho form of a summons, and that a few days after tho work was done. Dr. M'Arthur, S.M., agreed with Mr. Fitrgibbon's view of tho matter, and entered judgment for the defendant. It was, at the samo time, understood that the 6s. would immediately be paid over. Miss Jcrmyn, however, observed that she would not take the money, and left the Court. UNDEFENDED CASES. In the following cases Dr. M'Arthur, S.M., entered judgment for tho plaintiffs by default:— Jack Jacobus v. W. Hall, £2 18s. 6d., and costs 55.; Mandel and Carr v. J. Greenfield, £12, and £1 10s. 6d.; R. E. Tingey and Co., Ltd., v. Harry E. Hughes, £7 45., and £13s. 6d.; W. H. Suckling v. T. Ellis, £13 95., and 10s.; same v. John Ropata, £19 18s., and £1 17s. 6d.; same v. W. Rikiliana, £10 ss. 10d., and £1 15s. 6d.; same v. Naihi Waka, 13s. lid., and 10s.; same v. Waru Horito, £5 18s. 4d., and £1 Bs. 6d.; same v. Tiki Hapita, £1 19s. Id., and 10s.; the Fleet Printing Co. v. Albert Edward and Muriel Clemas, £10, and £1 6s. 6d.; R. G. Dun and Co. v. John Sharp, £10 15s. lid., and £1 10s. 6d.; W. H. Nash v. John W. Bockmann, £3 6s. 10d., and 10s.; W. Dimock and Co. v. Robert F. Spensley, £11 10s., and £1 10s. 6d.; Pritchard and Mitchell v. John Couper, £9 2s. 6d., and £1,35. 6d.; J. G. Raine and Co. v. Arthur Patchett, £6 15s. 3d., and £1 3s. 6d.; William John Lankshear v. Harrington Bros., £2 4s. 6d., and 55.; same v. Fredk. S. Harrington, £2 Os. 6d., and ss. JUDGMENT SUMMONS. JV. H. Kinvig was ordered to pay Samuel Brown, Ltd., £8 6s. 9d. by October 28.' POLICE CASES. As idlo and disorderly persons, Annie M'Grath was sentenced to one month's imprisonment, Mary Johnson to two months' imprisonment, and John Fraser to three months' imprisonment. George Hastings was fined 10s. for insobriety.
