MEDICAL MAN 4 HIS CLIENT. In the Magistrate's Court yesterday, Frank Garcia Webster,' medical practitioner, Wellington, sued 1 Thomas Wellington Raplev, insurance agent, Wellington, for £8 Bs., as for consultations respecting defendant's eyesight. Mir. P. H. .Putnam appeared for the plaintiff, ajidi Mr. ft. J. FitzgSbbon for the defendant. Defendant disputed the account on tho ground that it was excessive. 'l>r.. Webster maintained that tho charge was -usual, and that he had faithfully attended Rapley. Dr. M 1 Arthur, S.TM., who heard tho cas?, gave judgment for £5 ss. CARRIERS' CLAIM. Dr. M'Arthur, S.M., delivered l judgment in the case of O'Brien and Co., carriers, Wellington, v. O'Donmcll, a claim for £22 lis. 6d. ,fo-r tho paokage and- removal of furniture from Kilbinue to Auckland. Mr: W. H. D. Bell represented the plaintiff at the hearing, and Mr. A. Blair appeared for the de>fendant. • Mr. Blair asked for a nonsuit on t-ho ground that tho plaintiffs had l not completed the contract, inasmuch us they had not delivered two packages (whic)i were lost). His Worship dffl not consider t'hat bucJi a request could be entertained, because if. it could tho nondelivery of a minor article would deprive a carrier of any -remuneration at ill. . ' Judgment was for O'Brien and. Co. for the £22 11b. 6d. claimed. A counterclaim -by O'Donnell of £18 for goods damaged and! £10 12s. for goods not delivered, also, was' decided in favour of O'Brien, and' Co. • HEARING. CONCLUDED. Hearing of the case of Moncrief and Young, Wellington, v. George Bevan, farmer, Manakau, a claim ! for £50 alleged to bo duo'm respect of an order given; by a third l party, was concluded: by Dr. M'Art-lnir, S,M. Decision will bo given on September 23. For having esyapea from, the Salvation- Army Home, Agnes Wylie was sentenced to three weeks' 'imprisonment and ordered to be returned to the home.
