CREDITORS FELT SORE. (By Telegraph—Frees Association.) Auokland, September 10. Included in tho list of applications for dischargo dealt with at the Bankruptcy sitting of the Auckland Supremo Court this morning was ono by Arthur Henry Kempthorne, sawmiller, of Opotiki. The Official Assignee said that there TV as jio opposition to tho discharge except that two or threo Auckland creditors were under the impression that bankrupt was in a positiou to mako an offer in respect to his deficiency. Ho had examined bankrupt; liowover, and was of opinion that there was no chance of an oifor. Mr. Fisher remarked that bankrupt had tho sympathy, of his Opotiki creditors. Ho. had, however, carried on his business transactions in an.extremely careless manner, and his Auckland creditors felt a bit sore. Mr. Justice Edwards: But they should como hero with a. good reason why I should suspend the I must, of course, tako notice of misconduct, but I cannot nurse these thing's. If tradespeople recklcssly givo credit they should look after tho debtor.
Mr. Fisher said that tho feeling was that, through carelessness on tho part of bankrupt, the loss suffered had been, greater than it otherwiso would have been. Some property destroyed by firo had been insured, jbut tho policy was defective. , His Honour pointed out that such a matter could not be held'against granting a discharge and tho creditor themselves had a duty to perform in setting up opposition to discharge. An vrder was made granting dischargo.
