Tlie.se remarks were rando by tho Chief Jnstico (Sir Robert Stout) yesterday morning, when sentencing Arnold Ashn-orth Bians, who had pleaded guilty in the Lower Court to thirteen charges of the theft of jewellery (J!IGS worth) from tlie Cuba Street shop which he was managing for Mr. H. W. Lloyd.
His Honour further stated that he had carefully considered tho case, and that he regretted that he did not think it would bo in accordance with his duty to releaso Binns on probation or order him to appear for sentence when called on. Ho would, however, pass a very light sentence. Otherwise, it would simply mean that somo other man who had dono nothing worse than tho prisoner had dono but who happened to have no friends and no money might stiller injustice. He regretted that Binns had fallen through gambling, but, nevertheless, ho had broken a trust, and tho lightest sentence .that the > Court could pass was eight months' imprisonment with hard labour. IN DIVORCE, the fuller case in camera. His Honour Mr. Justice Chapman commenced the hearing of the divorco case John. Fuller, jun., v. Gertrudo Fuller, with Henry Percy Harris as co-respondent. Mr. T. Young, with him Mr. M. Myers, appeared for the petitioner; Mr. T. M. Wilford, with him Mr. P. W. Jackson, for tho respondent. Mr. Cracroft Wilson appeared for tho co-respondent. In terms of an order made, tho Court was cleared during tho hearing, and the publication of evidence was prohibited. Thetransmission of evidence was also prohibited. Evidence was heard during the aftornoon, and tho caso will be resumed this morning.
