COURT OF APPEAL.

THIRD DAY 01' SUGAR CAKE. Yesterday Hie Court of Appeal was again engaged all day in hearing the appeal of the defendants ill the sugar case— the first prosecution under the Commercial Trusts Act, 1910. Particulars of the case were published last week. Yesterday was the third day . of the hearing, which will occupy the Court for some days yet. Mr. Justice Williams is presiding at the appeal,'and sitting with him are Mr. Justice jDenniston, Mr. Justice Cooper, and Mr. Justice Chapman. The appellants are the Merchants' Association of Now Zealand, Incorporated, a trade protection society, Wellington; the Colonial Sugar Refining Company, Ltd., incorporated in New South Wales, sugnr refiners and sugar merchants, Auckland; Levin and Co., Ltd., W. 51. Bannatyne and Co., Ltd., and Joseph Nathan and Co., Ltd.; all merchants of Wellington.-' The respondent is his Majesty the King. Mr. C. I'. Skerrett, IC.C., with Mr. T. Your#;, is appearing for the Merchants' Association, and for W. M. _ Haiinatyno and Co., Ltd., and Joseph Nathan, and Co., Ltd. :.Mr. J. 11. Hosking, K.C., of Duiiodin. with Mr. 11. P. Richmond,, of Auckland, represents the Colonial Sugar Refining Company, Ltd., while Mr. M. Myers is in the case as counsel for Levin, and Co., Ltd. The Attorney-General (the Hon. A. L. Herdman) is appearing for the Crown, and lie has with him Sir John Findlay, K.C., amP Mr. H. H. Ostler, of the Crown Law Office. ' Mr. Skerrett. who commenced his address to the Court on Wednesday last, concluded shortly before mid-day yesterday." Mr. Young occupied the remainder of the morning,' and Mr. Hosking followed in the afternoon. . The last-named was .'still ■■addressing at 4.30 p.m., when the " Court adjourned .Until'half-past ten o'clock this morning.
