SUPREME COURT. (Before His Honour Sir Robert Stout, C.J.) END OF A DANNEVIRKE CASE. 'An appeal from the decision of the magistrate in <1 Dannevirke case was lieard in the Supreme Court on Saturday morning before his Honour the Chief Justice (Sir Kobert Stout). The appellants were 11. It. Ries and Sons, cycle agents, of Dannevirke, and the. respondent was A. 31. Mason, farmer, of Oporae. Mr. I'. H. G. Lloyd, of Dannevirke, appeared for tho appellants. Mr. P. B. Fitzherbert, of Dannevirke, was for respondent. In tho original action, Mason (respond'ent in tho present case) proceeded against Ries and Softs to recover damaees for misrepresentation in regard to the sale to. Mason of a second-hand motor cycle. The magistrate held that there had been misrepresentation, and nave judgment tor the plaintiff (Mason). From this decision Ities and Sons appealed on the ground that it was erroneous in point of law. \After hearing Mi'. Lloyd, his Honour considered that it was not necessary to call on respondent's counsel, and the appeal was dismissed.
