Thomas Sherlaw, watchmaker, Johnjonville, proceeded against Joseph Lewis, proprietor of the Central Cleaning and vacuum Cleaning Co., Wellington, claiming ,£2OO as damages suffered through a ladder left by one of defendant's employees. falling on him (Sherlaw), whilo ho was walking along tho footpath. Sherlaw stated that ho received injuries to one of his feet and to one of his hands, and suffered severe shock, and that he was prevented for a considerable time from attending to his business. Sherlaw claimed X' 72 as general damages, .£25 as medical and surgical expenses, .£l3 as hire of motor and conveyance, and .£9O as loss of earnings. 1 Mr. D. M. Findlay appeared for the plaintiff, and Mr. M. Myers, with whom was Mr. P. H. Putnam, for tho defendant. ! It was stated in tho defence that tho day of tho accident was windy, and that if Sherlaw had not had his head down because of tlio wind ho would have avoided being struok by the ladder. i Decision was reserved.
