IN THE S.M. COURT. A very unusual incident occurred in a case in tho Magistrate's Court yesterday. The case was one in which a man and his wife, who arc living Apart, were concerned. The wife has the custody of their child, and the husband' is 'supposed to have access to the little, one onco a week. The husband applied'for a" variation' of tho order made by the Court in the matter, and tho alteration' he wished was'thoj;another place should be fixed as the house at which he should visit his child. ; Mr. T. M. Wilford appeared for tho applicant (the husband), and Mr. A'. It. Atkinson for the defendant (the wife). When the wife was in the witness-box, Mr. Wilford cross-examined her as to whether or not she had corresponded with a man who lives in Canada. Witness answered that she had not. Mr. Wilford: If I produce a letter ac : knowiedging one you sent to Fred. — in November, will you deny it? Witness: I will. Mr. Wilford took in his hand a letter which he said was signed "Yours.'Fred." Again he asked witness if sho would swear that the letter which ho had was not in answer to one written by her on November 5. .''.-.- - , • '■ i . ! Witness: I will swtar it. Mr. Atkinson remarked that the letter 'had not b?en obtained in a desirable .manner.- He asked that the letter should be handed to him, so that he might read it. . 'Mr. Wilford refused.. ; .' ; The magistrate said that Mr. Atkinson must ba allowed to read the letter.' Mr. Atkinson eaid. that' Mr. ' Ward's; procedure was scandalous. It was wrong ,to hand him only portion of a letter after cross-examining his client oh' the com-, munication.' i. . ",' Mr. Wilford said that counsel could cross-examine from anything—say, a ribivfc paper clipping. Ho then handed. Mrl Atkinson one sheet of the letter, and then folding another.'sheet ''''put it in an envelope. . Mr. Atkinson appealed to tho Court to uphold his view of the matter.
