SUPREME COURT. (Before nis Honour Mr. Justice Chapman) FEES FOR CITY HOARDINGS. . . QUASH THE BY-LAW? A motion to quash a city by-law was heard in tho Supreme Court on Saturday by Mr. Justico Chapman. Tho action was commenced under tho By-laws Act, 1910, Lawrenco Goodwin Porter, advertising agent, moving to quash Section 79 ot the Wellington City By-law No. 1, 1908, which imposes a license fee on hoardings used for posting bills, fflie grounds of tho motion were: That the license fee is grossly unreasonable and excessive. Mr. 11. F. von Ilaast appeared in support of tho motion, which .was opposed bv the City Solicitor (Mr. J. O'Shea). Tho point at issuo was whether the foe. should bo merely a registration fee,' as Mr. von Haast contended, or whether tho council lias power to restrict hoardings by imposing a fee in tho nature of a tax,as contended by Mr. O'Shea. After hearing argument, his Honour reserved decision. SECURITY FOR COSTS. An interlocutory proceeding in conneo tion with the divorce petition—John Fuller v. Alice Gertrude Mary Fuller and another—was heard in Chambers before Mr. Justice Chapman on Saturday morning, when respondent asked for security fori costs. Mr. T. M. Wilted appeared in support of tho motion, whilo Mr. T. Young appeared for the petitioner.After hearing counsel, his Honour made an order directing that the . petitioner should find security to the satisfaction of the Registrar in tho sum of for respondent's costs, _and also ordered tho petitioner to pay two guineas cost of tho application.
