APPEAL IN AN OLD CASE. la the Supreme Court on ! Saturday, Mr. Justice.Chapman heard an appeal from a magistrate's decision, in a ca§e heard o few years ivgo. The parties were William Geo. Em'Ay, builder, of/Wellington, appellant, and Harry Wilsoii Davies, plumber, of Wellington, .respondent. i Mr. A. W. Blair, with Mr. E. J. Fitzpibbon, appeared for the appellant,'while Mr; A.. Gray, IC.C., with Mr. D. K. Hoggard, appeared for the respondent. In the Magistrate's Court some years ago, Davies sued Emeny for i£l2o, alleged to be due for work done. Dr. A. 'M'Arthur i gave judgment for Davies; The decision was' appealed against by, Emeny, and the.appeal-was heard by Mi: Justice Chapman. \ The latter gave iin inttiim, judgment, but required um'eT Section 155 of the Magistrate's' Court Act) additional evidence concerning custom in the trade in regard to tenders. This, evidence was tendered on Saturday, and nfter hearing it his Honour reserved decision.
