FATAL WALK ON THE RAILWAY.
EXTENT OF EMPLOYEE'S LIABILITY (By Toieirranh.—Press Association.) Dunedin, December 20. ,The Arbitration Court to-day heard ei compensation claim, Dougherty v. Milne, a claim for <£500 in connection with tha death of the plantilf's husband at jvyndham on April 8. The deceased had been commissioned by Mr. Milne, .his employer, to inspect a horso with a view* to purchase, and while walking along tho railway lino on'his way to inspect the animal, he was struck by ail engine and killed. ' , ~ . The defence contended that tho accident did not arise out_of the deceased a employment, and that tho act of tho deceased in walking on tho railway hue v;oa obviously dangerous and unnecessary. The Court expressed the opinion that tho accident arose in tho course of tho rfecoasod's employment, "but a decision vas reserved. .
