NOTES AND COMMENTS,
[3r Glescob.] Yo.-terdav morning C. Price, after consultation with his solicitor, instructed tho latter to telegraph to. tho C.J.C. asking for a copy of tho minutes, and the evidence taken at the meeting at which ho was disqualified, as he wishes to prepare his appeal from it. Price will not admit that he has no ground for appeal. ' Ho contends that, despite tho alteration to Pule 7,. Part XXXI, of the "Pules of Racing" (making it impossible to appeal on a "question of fact"), he has still the right to appeal on tho succeeding rule, which .states, inter alia:—"Any person aggrieved at any decision, may appeal," etc. The contention is that this rule, comiug after Kule 7, is still operative, and will remain so until it is repealed. This seems to ho logical, and, incidentally, it would appear as if there is an urgent need for an early and complete revision of tho "Rules of Pacing." Tho Officer gelding Bercola changed hnnds recently, and is now an inmate of ,T. Fryer's Ha'wera stables, It is Fryer's intention to make a hack hurdler of tho chestnut, and ihe will probably start in" his first raco at Wanganui at the end of tho month. "While at the Marton meeting the successful apprentice, W. Bell, was approached by "Mi". Highden," and offered a good inducement to proceed to Sydney by today's boat, and remain there over the Pandwick fixture. This may mean that Poirone is to start in the Epsom Handicap, and that, consequently, Dceley will be unable to ride Ermengarde in the race in question. Tho old Sou'-Wester gelding Bourrasqne, who should have made a good hurdle horse, broke down badly at Awapuni last week, and it is unlikely that lie will race again. He was owned by tho Hastings sportsman, Mr. H. M. Campbell, M.P., who acquired him some time ago from his late owner, Mr. L. Pascal. F. Meagher only took to riding over fences this year, but, already, ho has had three horses killed under him. These were Posegrovo at Hastings, To Paluii at Trcntham, and Hnkari at Marton. Many riders predicted that the lastnamed horse would sooner or later break his neck, as, whon jumping, lie \ised to "take off" at - impossible distances. It is understood that, at the hearing' of his appeal, Jockoy C. Trice will ask to liavo tho assistance of a well-known Tnranaki sportsmnn in conducting his case. Ho points out that there is precedent for euch a procedure, as. at tho Julian appeal, Mr. W. P. Archibald was allowed : to appear. Price expresses confidence that this request will be granted. Ho holds the view that the Canterbury stewards' will not wish him to be handicapped in: any way by inexperience. " Malt King has done a fair fhare of racing, and'it says .a. lot for. his consistency that in 32 starts he has only missed a place nine times, and on four occasions ho ran fourth. He has won 11 races, finished second in eight, and ran third in four. The • Parisian,- Bobadea, Eudorus, and Wolawa are in the Memsie Stakes, to be run at Caulfield to-morrow. Iu view of ■their Cup engagements, their running will arouse, much interest. On August 27, the day before Brookong won tho Dnnalister Handicap at Moonso Valley, his owner-trainer, E. A. Connolly, offered Jo take .£l5O for the horse, niick at tho time remarked: "Ho is sure to wiiv at Mooueo Valley to-morrow." No deal, however, resulted, but after the race G. Mintcr, another Flemington trainer, gave .£125 for him. The New Zealand-bred Gaby (Menschi-' koff-Nannic) had (Ist. 121b. in the Ascot Thousand, which was to have been decided in Melbourne yesterday.
