Auckland, May 18, Following upon the throwing out by the Arbitration Court of th© claim by the Department to recovcv _ ,£2OO from tho Waterside Workers' Union far an alleged illegal strike, Mr. E. W. P. Gons (Inspector of Awards) this morning iiled, ni the Magistrate's Court, summonses against Mr. Jas. Collett and thirty-four men connected with tho Waterside Workers' Union. In respect to the secretary, ,€2OO is claimed, and, from each of tho thirtyfour men, .£lO. It will bo remembered that, at. the Arbitration Court, Mr. Justice Sim held that the union as a body was not responsible, arid cipressNl surprise that tho Department had not proceeded s against Mr. Coilott for aiding nnd abetting, and airainst the men for taking part in an unlawful strike. Tho against the union was brought up ii-t tho Magistrate s Court in tho first instance, when Mr. Kettle, S.M., suggested that it should bo referred to tho Arbitration. Court in order to obtain tho decision of the 'highest tribunal M to how far tho acts of a secretary of (v union bound the body as a wholo. Mr. Justice Sim, having ruled that tho union as a body is not responsible, tho caso therefore comes onco moro bci'oro tho Magistrate's Court.
