«— (By Telegraph.—Special Correspondents Wanganui, June 29. Tho decision of Judge Sim, in a rather interesting case, came to hand to-day. The case, which was heard here on June 19 and 20, was one in which tho Aotea Maori Land Board sued a Native, , Pauro Marino, for trespass. The board, some time ago, set aside part of the Mcrikau Block to bs farmed for the benefit of Natives, and appointed a manager to carry on the farm on behalf of the board. Defendant, who was one of 820 Native owners, entered upon part of the farm, erected fences, and depastured stock thereon, tho present proceedings being the outcome. Bis Honour said that the case depended on the validity, or otherwise, of an Order-in-Council, issued in December last, vestin;; the block in the board on behalf of l.lie owner's. Tho defence contended that the order was not valid, because the block was not "Native land" within the meaning of the Maori Land Settlement Act Amendment Act, 1006. His Honour held otherwise, and issued an injunction restraining the defendant from further trespass on tho laud, with costs and other expenses on the lowest scale. He also directed an inquiry to be made us to the amount of damage done by defendant. Judgment for this iamount, is to issue later. In ,i cross-action, in which Panro claimed .£125 diumsos from several Native employees of the board for destroying his fences, judgment was given for defendant with costs.
