ll)y Tcleeraph.—Press Association.) Auckland, June 1. A somewhat unusual case was hearß nfc tho Magistrate's Court to-day in which the Inspector of Factories (Mr. W. Ho"'i| had taken action against T. AV. Kwai lor not having closed his shop at 1 p.m. on the weekly half-holiday. The facts of the case were that defendant keeps a restaurant which is entitled to be open on the half-holiday for the convenience of persons wanting a meal. Mr. Hood contended that as cigarettes were sold on the same premises it became, a shop and had to be closed the same as any other shon. Mr. Skelton, £91- tho defendant, said that tho main business of tho establishment was a restaurant. He argued that because half a sovereign's worth of cigarettes were kept on tho premises for the convenience of customers it was absurd to say that the restaurant must closo on tho weekly half-holiday. Mr. Kettle, S.M., said that the Ipoint raised was one of considerable importance and ho would therefore take time to consider his decision.,
