CHARGE AGAINST A MOTORMAN. (By Telegraph.—Press Association.) Auckland, March 1". In the charge of manslaughter against. Ernest Dawe, tram motorman, arising out of tho death of Thomas Albert Thompson, who was killed by a moving car bumping a standing car in Hobson Street, on November 21), tlie jury found accused guilty of neglect of duty caused by extenuating circumstances, but not of . gross neglect, and strongly recommended him to mercy. In reply to Mr. Justice Cooper,, the foreman of tho jury said tho jury was not unanimous in regard, to the extenuating circumstances. By consent of tho Crown Prosecutor and counsel for the prisoner, the finding was accepted and reserved by his Hon" our for consideration in the Court of Appeal as to whether it amounts to a verdict of guilty or acquittal or whether a new trial should be ordered. Accused was admitted to bajl, to appear at the next criminal sittings.
