Justice' AVilliams.'gave judgment this morning in 'two cases of considerable importance.-to exporters. The -lirsi case wiis-in'respect to. a frozen meat contract between Price, Griffiths, and Co., Melbourne, and the Southland l< rozen Meat Company, in which tho plaintiffs claimed damages- for breach oc contract. The'company had taken over ono Thompson's • business, and also' his contract to cMivor 400 cases of. tinned mutton to .plaintiffs. His Honour.: held there had beeiv a-breach of contract, and that dcfenilanS was liable for tho breach. Judgment was given, for plaintiffs for ,£550 and costs'. " • The second case was between the' seaward 'Downs Dairy Factory Company and: -Lov* and Christmas, London, in which plaintiffs'claimed they had not fcc'n.paid the total amount they wero entitled to.under a contract. The eontract weis made between Batger," agent for, defendants, and. plaintiffs, > purchase cheese at s!d. per lb.;' and also to purchase tho output of other, factories. Plaintiffs wero 'paid the sum mentioned, but claimed they"!wero entitled to more, because Batger, on behalf of defendants, had agreed to purchase the Woodlands Factory output at a higher rate. The Judge held that dcfenuWs.' wore notbound by BatgM-'s contract ' with tine Woodlands - Factory, therefore defendants wero not entitled to pay more, than Hd. per lb. Judgment was given for defendants.
