The Supreme Court has been invoked to remove: a legal difficulty concerning the property of bt. James's Anglican CliUrch, Lower'Hutt. Mr. P. G.' boiton, appearing for Sydney; Clark Barraud, Prederick de Jersey Clere, ind Walter Collier Cuff, all of Lower'liutt,.trustees' of the property .in question,: stated thatthe purchase of the land (which adjoins the church premises) was made on trust lor the erection of a parsonage. The trustees wished to raise .£725 by way of mortgage, on the land to pay for the erection of a parsonage and. incidental purposes.! The building was already partially" erected, and the builder was asking for: a progress payment, but it had been' found that the legal documents in the matter gave tho. trustees\no power to sell or mortgage the land. They had, however, arranged with the New Zealand Investment, Mortgage, and: Deposit Company, Ltd., for an advance of ,£725 on the security of the land and buildings for the term of .five years at £! 10s. per cent.; reducible to " 10s. per cent on. punctual payment and payable ouarterly. The trustees, therefore, asked to be empowered to execute the mortgage. The Chief Justice (Sir Robert Stout), when the matter was before him some days . ago, adjourned the case to eDable-'the written consent of all . the vestrymen to bo filed.
