I'hreeVaccused .pleaded'not : guilty. . voln. evidence ;thb .chiefyofScer (Mr. Bevis) stated ' that -Driscoll was.; under the influence of drink on'Friday'morning.: On ' tetm-n - 1 to.; work vhe',''said.that he ' would go Wheh' ie. ,was;'-ready.; On Saturday morning lie did not turn to* with I'thfe; other,-.men, but; did'.not . remember giving. him any order. the, men . GUbey and'. Wood-; thorpe they had . been told' to Cleave; their quarters on Friday afternoon between. 4 'and;s o'clock,; but at half-past, seven the chief officer was.informed'that they were still there; and refused ;to; leave. Witness.. could not remember having given' .them any •■'distinct order; on, Saturday, but :he :gaVean; order at Ilobart .on September ,18," and'; theywere still", disobeying .t'liat. : "v.-'.V:'; 'Alexander Smith",'second;officer, of the ■Torigarirq,.. said ;.that he gave' Gilbey and; Woodthorpe an order to leave their .quarters on Friday afternoon. They,left aDout toalf- an'.-hour later. - They did, not disobey his orders. ' '.■ His '. Worship remarked , that Driscoll must be' discharged : on the; charge of disobeying . orders; on. Saturday. as: the officer • did; riot';remember giving any 'As regarded; -the charge against;. the,: other; men';, of' combining to; disobey orders .on. Saturday there . was no evidence' iin support r'of it. They would also bo discharged. . ' OTHER CASES. • Clara Algar, against whom; there ' were .71 .previous convictions, was. sentenced, to, 21 days';imprisonment on; a" charge, of drunkenness'. For procuring .liquor during the currency . of; a . prohibition order, the same accused, was convicted and- discharged.' ■ •?'-■;'• . . Sarah, .Tamieson was ' charged with drunkenness... and with procuring liquor during' the currency, of a prohibition order."There were, forty-five previous convictions'against; her. A 1 fine of 40sJ was imposed on. the second charge with;.the. alternative "of 14 days' imprisonment. On the (Charge :of drunkenness ; accused was .convicted and'discharged.' ] '•" ■•. Chas. Collins, .charged with drunkenness and \ withv procuring liquor dnring the currency of a prohibition order, made' no appearance. On the first charge he was,:fined iOs., with the. alternative, of 24 hours' imprisonment, and on the second ho was fined 405., in : default 6even days' imprisonment. Richard Shield, on a -charge of drunkenness,.', did not' appear;and was ordered to forfeit'.'his bail, i 205.,- in . default 48. Hours'" imprisonment. John Gilbey, for drunkenness; , j'was penalised .to the extent of 55., in dofault 24 hours' imprisonment. ,A • ■ first-offending inebriate who did not appear ; was . ordered to' forfeit his bail of 10s. . Two first offenders, appearing on bail, were each fined :55., with the alternative of 21 hours' imprisonment; and two' others, who ; had been locked up all night, , were convicted. and discharged.
