INDUSTRIAL CASE.
AN IMPORTANT POINT, (By TeleeraDb—Press Association.) Rotorua, June 21. Mr. Dyer, S.M., gave a very in> portant ruling here to-day in an im dustrial case: Inspector of Awards v.M'Namara. Defendant, a baker's asi sLstant, an employee of A. G. Ootterell, had worked overtime and failed to claim the higher rate of wages prescribed under the award. Mr. Hampson. appeared for M'Namara, and contended that,no positive duty was cast on an employee to claim such wages, and that M'Namara had therefore committed no actual breach of the award, the award, being final, having to be strictly construed. He quoted Mr. Justice Edwards in Baillio and Co. v. \ Reese, 8 S.L.Ri 789, in support. His Worship stated that he agreed with Mr. Hampson's contention, but as the matter was of vital importance in an industrial award, he would adjourn the case, and state a case for the opinion of the Arbitration Court. Tho ruling of the Court will be awaited with great interest.
