DRAY AND MOTOR CAR.
&" COLLISION. CLAIM FOE DAMAGES. (By Telenraph—Press Association.) Christchurch, May 12. The Board of Governors of Canterbury Agricultural College were proceeded against to-day by Jesso Thomas Blakemore, who claimed £60 ss. Cd. for damages sustained by him in a collision between his motor-car and a dray driven by servants of the defendants. Counsel for plaintiff stated that on December G last plaintiff was motoring vfhen he met a dray belonging to the Lincoln ■ College, loaded. On the d-ray was a polo thirty feet in length, extending'from the horse's head at one end and about 13 feet beyond the back of tho dray. As tho two vehicles met the horse swerved, swinging the polo .round, and tho end strnck plaintiff, rendering him unconscious and incapable of controlling his car, with the result that it ran into a fence at tho side- of the road and was damaged. The caso was one which spoke for itself, as defendants, whilo entitled to carry a load, had rendered themselves liablo for any injury which was occasioned through tho load being carried in such a way that it might, have caused injury. As a result of the accident plaintiff's car was damaged, and for three weeks he had been wholly prevented from attending to his business; for two-weeks ho had been able to do only light work; and was still unable to perform duties that he had carried out previously. Evidence was given in support. The defence called in evidence to showthat the accident was due to plaintiff's negligent driving, and that it would not have occurred if ho had exercised proper care, and had not been driving so fast as to frighten the horse. On the application of counsel for the plaintiff, the case was adjourned for legal argument.
