An action, heard yesterday in tho Magistrate s Court at Temuka, decided a point of some interest to farmers, 'whether landlords or tenants. The defendant. (Young) was tho losseo of the plaintiff's (Kennaway's) farm near Temukti, and, in his lease, had covenanted not to crop with a "grain or dry crop' more than a specified number of acres m any one year. The lease contained a covenant that tho tenant would pay an additional rent of £3 for every acre so cropped in excess of the permitted area. It was allegod by 'plaintiffs that, during last season defendant had cropped 47 acres beyond the amount allowed, and tho sum of £140 for additional rent was sought to be recovered. Defendant's answer to tho claim was that tho excoss of crop consisted, not of a grain" crop, but of a "green" crop. Tho ovidenco showed that a cr.op.of oats, which was tho crop really in dispute, had been cut green.after the ear had appeared, a reaper and binder being us6d for the' purpose, and had then been put' into stool: ■ to maturo. The oats-were subsequently stacked, part being cut for oatsheaf chaff, and part retained to be applied, later' to v a similar use. A sample of the grain was produced in Court. Though tho grains were poor, andy on tho whole, immature', yet it was shown by defendant's witnesses that somo of tho grains would have germinated. His Worship held that, in tho faco of iliis testimony, and taking into account tho fact that tho crop was cut with'a reaper and binder and placed in stook 'to. ripen; tho crop must be held to bo a "grain or dry crop," and, not- a "green crop." Tho overcropping, howevor, did not oxfcond to beyond 20 acres, and his' Worship accordingly, gavo judgment for tho .oJaintiff for £60 and

A CANTERBURY PROPOSAL. (by telegraph—fress association.) Chrlstchurch, Juno 16. ( 'At tins afternoon's meeting of the Now Zealand Farmers' Union Executive tho chairman (Mr. 11. Evans) referred to tho deputation consisting of Messrs. Davey, Laurenson, \wtty, Ell, Buxton, Craigie, M'Laren, Arnold, Glover, and Poole, M.P.'s, which waited on the Minister for Railways to urge that tho regulation, under - which sacks containing wheat, oats, or barley exceeding 2031b5. aro charged four times ordinary freight, should bo extended to apply to other produce which has to bo handled by manual labour. Tho speaker said that many extravagant statements had been made by members of tho deputation in regard to tho weight of grain sometimes put into sacks. It was stated that bags wcro made to contain as much as I 2701b. of grain, and he thought that a subcommittee should bo appointed to ascertain facts, and Communicate them to tho Minister. Mr. T. H. Davey had stated that tho Canterbury Farmers' Union had poohrpoohed tne idea that men could not- carry 240 to 2601b., alleging that tho raco must bo deteriorating. Such a statement the chairman • said was quite incorrect. Tho union had not discussed the question of the weight which a man should carry. Tho only thing discussed was the sizo of the sacks. After discussion it was resolved that the Minister for Railways be written to stating that tho executive was in favour of all grain and seeds in bags being limited to 2001b.
