(FROU-ODB SPECIAL 'BEFOHTEB.) :'. ' - LOWER HIJTT COURT. A sitting of the Magistrate's Court was held yesterday at' Lower Hutt, before Dr. M'Arthur, S.M., and Mr. John. Cudby, J.P. ; ♦ A Dog Bite.—William Howland (blacksmith) claimed fromH. Ernest Leighton' Oand ; agent) the sum of ".£SO, for damages alleged to have been done to a son of the plaintiff by defendant's dog. Mr. J. J. M'Grath appeared for plaintiff and Mr. A. S. ■ Menteath for defendant. -:The statement of claim set out that defendant 'owned a , St. Bernard dogi .and , that, on February 2 last, it attacked Henry George Howland (aged seven years), and severely bit bim on the.arm. Mr. M'Grath. 6aid that three of, defendant's children had been walking along the street past plaintiff's house when the dog rushed out and bit 'him on the arm. Defendant had paid into Court ,£5, and had also paid the doctor's' expenses (£2). He had. also' destroyed the dog since the occurrence. /Mr. Menteath •asked for a non-suit on the ground that plain.tiff .was not entitled to claim damages unless there, was .'evidence, of loss of service. Judgment was reserved until May 3, Mr. M'Grath to have an opportunity before then to reply on the: non-suit point; ; ' •. \; Goods' Supplied.—ln ; the civil cases, .Peter Hansen v. ; Edwin Hobman and v.. George Fawoett, judgment was given for the plaintiff for, JC2 3s. 9d. (costs .£1 75.), and M 17s. 2d. (costs Jtl 75.) respectively.' . Breach of Contract;— For alleged breach of contract;-, Charles Jackson, farmer, of Taita,' sued James Ferguson,.: dairy farmer of' Nai Nai,, for i£so. ■ Mr. Fair appeared for plaintiff; and-Mr. M'Grath for defendant. It was alleged that- in November last agreed to employ the; plaintiff delivering milk for one year' at JE3 per' week, and that' the' employment had been terminated in March. After evidence, judgment was given for; plaintiff for. the full amount, with-,£5 costs. ,
Plea for Separation—Ann Howland made apElication for an order of separation from her usband, William Howland, on, the ground -of continued cruelty. Mr.' Webb, who appeared for the complainant, stated that - the parties had. been' .mamed : in August, 1894,' and' that complainant-had suffered great cruelty ever since. . Defendant was a man of violent 1 temper, and 'had threatened the lives of his wife and family, on several occasions. Mary Harris, wife,of,John-Harris, ganger, stated that de-; fendant 'had assaulted \his wife , three, years ago: - Complainant enumerated, 'several instances of cruelty suffered at the hands of her husband during the fifteen years of their married life; '. Ellen Howard and Susan Brace also Rave-evidence in .plaintiff's behalf. Called bjr Mr. Alison, for defendant, the borough engineer, Henry Kix-Trott, stated that the defendant ; had worked for the council for about three, years,, and had proved himself a reliable, honest, and hard-working man. ; WRONGFUL METHOD OP 'RECOVERY. ' . In'one oaS6 a t Lower Hutt yesterday morning, the; magistrate (Dr. M'Arthur) deprecated the aotion taken ,to recover a wheel and crank, part of a horse-clipping" machine. A charge of theft .-was.. laid by James Ferguson against a young man, tho son of. a neighbour. ; . . Mr. Wilford, who . appeared for the accused, jsntered a plea of riot ; ~ "In evidence, complainant stated that 'the wheel and "crank,. which _ had; been recovered
from l accused's workshop, were part of a horseclipping machine; The parts had been taken from . the machine where it lay in an open shed. He had not asked for the articles to be .returned. ' Accused stated .that he had taken 1 the wheel' and'crank thinking them to be past use, and he had;fitted them up in connection with'a lathe. - Mr. Wilford said that the accused was a very bright lad' at engineering, and he had' an excellent character. . It was wrong "that the criminal machinery of. the Court should be used for.- the. purpose ' of: recovering '• the property. • . .... . . '' "v. .. . The. magistrate remarked that. he had no hesitation, in saying that, before any person took'criminal proceedings, he ought to exhaust every remedy at the Civil Court. In this case, the lad might have been.wrong in taking the articles without' asking permission,, but Fergu-son-was equally : wrong -in- taking these proceedings. •; The magistrate then admonished' the lad,, and dismissed; the information., ALLOTMENT OF FOOTBALL GROUNDS. , L The special-committee of Petone Borough' Council (consisting of. the' Mayor, Mr. J. W. M'Ewqn, and Councillors Castle nnd Smith), set up to.allot.football grounds for the season, met ;lait evening'in the Mayor's room, and discussed terms with the representatives! of Wellington Rugby Football Union, Messrs. Hales and. S. Brown.;'. •• / .• ■ A fortnight' ago the committee decided that Association players should have the" use of" one of' the four 'grounds ■on the, Recreation' Reserve. They resolved that grounds Nos. 1, 2, and: 3 should '".'be ' offered to .the' W.R.F.U. • for the season for .£165, the union \to have the whole of' the ; receipts.
