Muir and another v. Williams and party.— Action to recover £I.OO, damages sustained through alleged encroachment on plaintiffs’ claim at Pipeclay gully. After a protracted hearing, entailing the examination of a number of witnesses, a nonsuit was granted—plaintiffs to pay costs of witnesses (£3), costs incurred by defendants, and professional costs, £1 Is. Applications. Extended Claims. —Joseph M'Cabe and another, two acres, Bailey’s gully; James Parker and another, two acres, Nevis ; W. O'Connell and four others, five acres, Nevis -granted. John Baker, one acre, Adams’s gully-refused, not possessing a miner’s right when ground marked out. Water Races. —Charles Murray, three heads from Bendigo gully ; W, O’Connell and others, six heads from Whitten’s creek granted. Tail Races. —John Baker, Adams’s gully—refused, not having miner’s right when race marked out. Dry Race. —John Williams and ten others, on saddle between Pipeclay and Bailey’s gullies : objected to by Pryde and party and Muir and party. The Warden decided, as applicants had seen lit to construct the race without permission, not to give the grant applied for until it was seen whether the race would break into that of Pryde and party : time allowed, say four months, Protection. —Charles M‘Kenna, 90 days, claim at Bailey’s gully ; Robert Scott and another, 90 days, quartz claim at Carrick granted. Residence Area.— Francis Phillip, one acre, Bannockburn-granted.
