Tuuksday, June 20. (Before E. H. Carew, Esq., R.M.) Martin Erich v. J. Holltday.— Claim, £G lis. 7d. The bearing o? tins case had beeu adjourned on fhe previous Court-day. It now appealed that the summons had been served iu Dunedm. but that no affidavit of cause of acf'on had been previously lodged. His Worsb'p ordered a fresh sumolons to is.sue free of cost. Howell & Lougbnan v. Charles Hair.— CUim, £l4 145., for depas' ur'rag cattle on plaintiffs' run—Mount Pis.i Station. Pkmt'Sfc did Dot appear when caVed upon, and the case was struck out: plaintiffs to pay 193. costs of Court, and los. expenses to defendant. John Wilson v. Arcit. M'Leod.—Chum, £9 4-=. Mr F. J. Wilson, for defendant, put in a set-off amounting to £3 lis. 10d., paid into Court £3 93., ami pleaded not indebted for the residue. The plaintiff is a horsebreaker, and the defendant an hofelkeeper—both residing at Bendigo. The claim was for breaking-'a two horses belonging to defendant, and the principal point in dispute was whether or not the plaintiff was entitled to charge anything beyond the stipulated sum of £3 for each horse. Evidence was heard at some length, and the Magistrate gave judgment for the amount paid into Court : plaintiff to pay costs of hearing and judgment. TEMPORARY LICENSE. John HallirUy, of the Shepherd's Creek Hotel, obtained permission to keep his licenced premises open till four on the morning after the concert hi the Banaockbara School-house.
