The' sale -," was proved^ defendant himself admitting it, and Mr Taylor- argued that as defendant sold as agent for Speight and Co j brewers, Dunedin, he was not liable, and that if any offence was committed thoy - were liable. (Smith's Master and Servant, 328.) But Speight and Co. were not • liable, as they hold the necessary licenses, and they were not restricted to selling in any one place, but might establish agencies all over the Colony. The offence, if any, was malum prohibitum, not malum in se, and if his Worship thought there was an offence the fine should be a small one, as the sale was not made like the usual slygrog selling cases, but openly and in ignorance of the fact that a license was ". necessary. His Worship thought that as defendant made a profit out of the bottling ! over and above the commission which he* received from Speight and Co.,. and made out and receipted the bill in his own name, and not as agent for Speight and Co., he > had committed a breach of the law, and he would therefore be fined LlO ; in default, fourteen days' imprisonment with hard labour in H.M. gaol at Dunedin.
