DUNEDIN, Sept. 19. An unusual traffic accident point was raised before Mr. Willis, S.M., in the Magistrate 's Court today. Decision was reserved. The question was whether a motorist who is the sole occupant of a car, and who is involved in an accident in which no other car is cohcerned, is bound under Section 5 of the Motor V ehicles Act, as amended by Section 56 of the Transport Licensing Amendment Act, 1948, to report the accident to the police within 24 hours of its occurrence. It was stated that this was the first time the point 'had been raised. Mr. L. K. Stewart, for defendant, contended that this section- of the Act did not apply in such circumstances. Defendant was the only person involved. The section, counsel contended, had been framed to deal with hit-and-run drivers.
