WELLINGTON, Sept. 2. The long legal struggle over the right to sell sweets in St. James Theatre, Wellington, finished today when the Court of Appeal gave its decision in the case of John Fuller and Sons Limited against Lillian Adeiaide Brooks, of Wellington. The Court unanimouslv allowed the appeal and held that Mrs. Brooks liad no exclnsive right of selling sweets in St. James Theatre. No agreement had been shown that Mrs. Brooks should become a tenant of the sweet stall in the theatre. She had merelv been given tke use of the stall. The owners of the theatre had lawfully revoked iier licence to use the stall and as she held no tenancy her use of the' stall was not in any way protected by the Economic Stabiiisation Regulations. Costs were allowed against Mrs. Brooks in both the Supreme Court and Court o'f Appeal.
