AUCKLAND, July 21. An aceident to a boy at Westei'ii Spring* Stadium on Mav 20, was the subject of a cliarge of negligent driving so as to cause bodily injury, heard by A T t Justice Finlay to-'dav. Accused was a foreman in tlie employ of Wirth's Circus, George William Murray, aged 21. The vietim of tlie accident, John Sinclair Caskie, agedGl, was standing in a (pieue outside the circus ticket box when he was struck and run over by a large truck driven by Murrav. .His Ilonour told the jurv there was a real neeessity to fix for drivers, a standard of care that was sensible, not un]uly onerous on tlie one hand or unduly lax on tlie other. The ju rv brought in a verdict of not guiltv after an absence of two hours and added a reconiinendation tliat in view of future gatherings of a similar nature, tlie jurv considered that proper control of tratfie sliould be exereised by the civic authorities and under 110 circumstances shoubl vehicles be allowed to pass tli rough queues. Accused was discharged.
