. AUCKLAND, May 11. "This is fche seeoudcase that has come before*me reeently, where the evidence shows that the tenant lias a eompletely wrong* view of the proteetion afforded by the Tenancy Act, ' ' said Mr. J. H. Luxford S.M., in a reserved decision given in connection with the ease of H. Nuttal against it. H. Green. This ease was heard on May 5. Evidence was given to >show th&t plaintiff was a retired police officer who occupied the dwellinghouse attached to the Mt. Eden police station, Plaintiff retired froni the force on1 April fO and after retiring, had no legal right to remain in possession of the house. The Departmen-t, however, as an -act of grace, refrained from applying for an eviction order, to enabie plaintiff to bring proceedings. " Two other families are suffering hardship whilo plaintiff is in* possession of the house attached to the Mt. Eden poiice station," said Mr. Luxford. "I mahe an order for iinmediate possession. The order is to lie in the Court for four 'weeks from this date. JDefendant is ordered to pay plaintiff 's costs whieh j fix at £4 4s plus disbursements and wituesses' expenses. "
